Any statutory variation in service tax and MVAT within the contractualcompletion period shall be to BPCL account, against submission of documentaryevidence for substantiating the variation by way of relevant notification.However in case of delay in completion period beyond the contractual date, forreasons attributable to contractor, any increase in these rates shall be borneby the contractor, whereas any decrease in rates shall be passed on to theowner.

DEVIATION :

You are requested to have all your queries clarified before bidding. However,if you still have deviations from our RFQ and the attachments (specifications/ scope of work / Drawings ) etc. please indicate deviations in your offerunder a separate attachment titled 'DEVIATIONS' giving reference to RFQ clauseno. Deviations appearing in separate attachment of the E-Tender titled'DEVIATIONS' shall only be considered while evaluating the offer. In casethere are no deviations, please submit "NIL DEVIATIONS". Deviations mentionedelsewhere shall not be considered for evaluation.

NEFT PAYMENT:

Payments to contractors etc. shall be made by National Electronic FundTransfer (NEFT) only. Payment by cheque will be made only to those vendorswhose bank is located in the city where NEFT payment facility is presently notavailable. Bids received from vendors who are not accepting the NEFT paymentterms are likely to be rejected.

MSME CLAUSE:

Clause regarding ISO Certification and adherence:

BPCL Mumbai Refinery is an ISO:50001:2011 certified Refinery and is focused onenergy efficiency. In line with the same, all contractors providing servicesfor BPCL Mumbai Refinery should preferably deploy energy efficient equipmentssuch as energy efficient welding machines, LED / CFL temporary lighting andtemporary window AC of BEE 4-star rating and above for execution of the work.

Exterior and Interior civil works for Modified NHT /ISOM SRR, Control room,Sub station

1) INTRODUCTION:

Exterior and Interior civil works for improving aesthetic of Modified NHT/ISOM SRR, Control room, Sub station.

Contractor should apprise himself of all the conditions prevailing in suchlocation and the restrictions placed on movement of personnel and equipment.Types of equipment and tools permitted, working method allowed etc in thelight of security and safety regulations operative in the area.

2) SCOPE OF WORK:

The scope of work covered under this contract is to carry out various kinds ofcivil and architectural works like plastering, fixing glass mosaic tiles,painting and furniture items like tables, workstation, wall panelling,P/F BPCLlogo, inaugural plaque under supervision of architect and civil engineer.

For carrying out above mention work contractor shall deploy Architect(B.Arch).Architect needs to develop drawing and get it approved from EIL/BPCL, andensure work is being executed as per approved drawing.

The contractor shall carry out all types of works listed in 'Schedule ofrates' As and when required throughout the period of contract as per thedirection of Engineer-in-charge(Engineers India Ltd. - RCM NHT/ISOM Project).

Scope of work includes all the civil works as mentioned below but are notrestricted to the following.

The total jobs will be executed as per the following details & direction ofEngineer-in-charge:

1. Providing and fixing glass mosaic tiles on wall.

2. Providing and fixing BPCL logo and individual letters in SS 304structural

3) SPECIAL CONDITIONS OF CONTRACT:

Please note that "Scope of Work" will be read along with the 'SpecialConditions' of this contract. Contractor shall be required to abide by theconditions stated in General terms & conditions attached.

3.1. Prior to quote for the job, the bidder will be required to visit the site& clarify all the doubts (if any) from Engineer- in-charge during pre-bidmeeting. Otherwise it will be presumed that the party has understood the workin all respect.

3.2 FIRES & SAFETY REGULATIONS

3.2.1 The work shall be carried out in a safe manner as per Refinery Fire &Safety Rules & Regulations. Work permit condition shall be scrupulouslyfollowed.

3.2.2 BPCL conducts an intensive training programme on various aspects of Fire& Safety, on regular basis, at Refinery-Fire Station. It is the responsibilityof the Contractor to nominate all the supervisors/labours (likely to beemployed for this job) for training through BPCL site engineer. The successfulcompletion of training is mandatory requirement (in addition to otherqualifications/experiences mentioned earlier) for any supervisor/labour to beeligible for working at Refinery work site. Failing which no supervisor/labourwill be deputed for working at Refinery work site. Contractor shall also sendall the other workmen deployed at Refinery for this training.

3.2.3 Contractor shall arrange all required safety gadgets like safety helmet,safety Belt, safety shoes, Boiler suit, Gloves, Goggles etc. for theirworkmen.

3.2.4 Contractor shall submit detail safety action plan & quality assuranceplan before start of work within 3 days from the date of PO & get it approvedfrom BPCL.

Scaffolding will be as per BPCL standards. As far as practicable the dangerzone around the work area should be adequately fenced off and sign painted,




3.3 MOBILIZATION & TIME SCHEDULE OF WORK.

3.3.1 Within 3 days of issue of contract letter the contractor shall prepare adetailed schedule of activities for completion of the work & shall get itapproved from EIL.

3.3.2 Also within 7 days of Issue of Contract Letter the contractor shallmobilize all necessary manpower & equipments & start the job at site asdirected.

3.3 The contractual completion period shall be 2.5 months from the date ofaward of job. The mobilization & detailed schedule of activities forcompletion of the work shall be submitted by contractor within 1 day and shallget it approved from BPCL/EIL.Prices quoted shall be valid considering all above.

3.4 SCOPE OF SUPPLY:

3.4.1 BY BPCL (free issue): NIL

3.4.2 BY BPCL (Chargeable): NIL

3.4.3 BY CONTRACTOR : All the material, Equipments to complete the work as perscope of work & as specified in SOR.

Raw water required for construction, etc shall be provided by BPCL atchargeable basis.

3.5 TECHNICAL PERSON AT SITE/DEPLOYMENT OF ENGINEER/ARCHITECT

The contractor shall depute experienced/qualified (Degree/diploma Holder)Civil Engineers and Architect (Degree Holder) with safety trained supervisorsfor site job.

Contractor shall sufficient manpower during agreed working period to ensureeffective output to meet the agreed schedule/ bar chart.

3.6 WEEKLY PROGRESS REPORT/LABOUR REPORT:

The contractor shall submit daily labour report & progress achieved inpreceding week and plan for next week.

Detailed construction drawings & other related documents on the basis of whichactual execution of the work shall be carried out will be made by architectafter taking actual site measurements so that there will be no discrepancybetween drawing and actual site condition .contractor shall submit detailedconstruction drawing for approval to EIL/BPCL.After approval of constructiondrawing by EIL/BPCL contractor shall execute the work.

3.8.1 Cement:- Cement required for all construction shall be provided bycontractor only. Cement used for ready mix concrete shall be Portland SlagCement (PSC) conforming to IS 455 or Portland Pozzolana Cement (PPC) Fly Ashbased conforming to IS 1489 Part-I as indicated in IS 456:2000. This shall beof approved make viz ACC, L&T, Gujrat Ambuja or equivalent conforming to IS:455 or IS: 1489 part-I.

Cement used for all other purposes except for Ready Mix Concrete shall bePortland Slag Cement (PSC) conforming to IS 455 or Portland Pozzolana Cement(PPC) Fly Ash based conforming to IS 1489 Part-I as indicated in IS 456:2000or Ordinary Portland Cement grade 53 (conforming to IS:12269). This shall beof approved make viz ACC, L&T, Gujrat Ambuja or equivalent.

3.8.2 Power: Power required for construction, shall be provided by BPCL atchargeable basis from nearest substation. Conctractor has to installconstruction DB and make necessary connection at contractor cost.

3.8.3 All other construction materials & equipments, oxygen & acetylene gases,consumables, transport, foundation bolts, nuts & Structural steel, etc.labour & supervision all necessary for completion of the job in totality.

the contractor without prejudice to the responsibilities to execute andcomplete the work as per the specifications and time schedule , progressivelydeploy construction equipment, tools and tackles and further augment the samedepending on the exigencies of work and as directed by the Engineer in chargeso as to suit the construction schedule within scheduled completion datewithout any additional cost to the Owner .

3.8.4 WORK TIMINGS:

Contractor may have to work in two shifts per day (per shift of 8 hours) asinstructed by Engineer-in-charge after taking all necessary permissions fromBPCL.

3.9 INSPECTION OF CONSTRUCTION MATERIAL & WORKS:

All civil works i.e finishing works, etc. shall be offered for BPCLinspection. All material procured by the contractor shall be offered for

All tests shall be conducted throughlaboratories approved by BPCL.

3.9.2 Civil Construction Materials

All construction works & material brought by the contractor shall be as perthe relevant latest IS specifications. The Engineer-in-charge/Inspectiondepartment shall have full authority to inspect the works at any time wheneverin progress either on the site or at contractors workshop wherever situated.All the test for e.g. Cube test, test for silt content of sand (as per IS 383,for Zone II & Zone III, as approved by Engineer- in-charge), etc. necessary inconnection with the execution of the works or material or workmanship suppliedby the contractor shall be carried out promptly by the contractor at his owncost from any other approved testing laboratory or at site as per theinstructions of the Engineer-in-charge/Inspection department.

Burnt clay bricks should follow the specifications as per IS 1077:1992.

Contractor should use the river sand for all the works. However, contractormay use the crushed stone aggregate in place of sand by taking necessaryapproval from Engineer in charge after conducting prerequisite tests, withoutany extra cost.

3.9.3 For execution of this job, contractor shall be required to getclearances from BPCL/Inspection department. Also contractor shall be requiredto submit Quality Assurance Plan for execution of the jobs & same shall beapproved by BPCL/EIL.The work shall be carried out in a safe manner as per Refinery norms & workpermit condition shall be scrupulously followed. The work should be plannedand undertaken only under the Supervision of a competent person.

No idle time wages or compensation for temporary stoppages of work orrestrictions would be paid and the rate quoted for various items of workshould cover the cost of all such contingencies and eventualities. Substantialstructures and utilities exist both above ground and underground, adjacent tothe work site, Special care is necessary in transportation, storage, workingon equipments and other construction activities to protect the existingfeatures and prevent damage to any facility.Necesary protective structures ,barricades etc have to be erected at various places as directed by Engineer incharge. No extra payment of such protective work will be made all roads andopen areas adjacent to the work site shall either be closed or suitably

3.10 HOUSE KEEPING: The contractor shall maintain good housekeeping on day today basis at the site/fabrication yard. All construction material brought bythe contractor (like sand, coarse aggregate, shuttering material, scaffoldingpipes etc.), steel scrap (like structural steel, reinforcement steel etc.) &other debris (like earth, shrubs, rubbish etc.) generated at site shall bestacked neatly in well defined spaces at no extra cost. Additional man- poweras & when required for housekeeping shall be arranged by contractorimmediately as per direction of Engineer-in- charge.

Cart away all the debris generated from the work outside the Refinery at hisown cost and dispose it off without giving rise to any complaints from local,municipal and government authorities. Certified copy of gate passes shall beattached with the final bill. Metal scrap or any other scrap including woodenmaterial shall be disposed category wise at his own cost as indicated by theEngineer in Charge. The weghment slip issued by the warehouse will be attachedwith the final bill.

All moveable, salvageable, serviceable material shall be dismantled carefullyand transported/ stored as directed by Engineer in charge.

The financial implication of above, if any should be taken care in the quotedrate and no separate claim shall be entertained on this account.

The final bill of the contractor shall be linked with the area cleaning in allrespects including disposal of debris/scrap etc. to the entire satisfaction ofEngineer in charge.

3.11 MEASUREMENT OF WORKS FOR PAYMENT: -

3.11.1 Measurment of works:

Measurements of works shall be as per IS: 1200 if nothing is mentioned in theschedule of rates/quantities.

3.12 The quantities indicated in the SOR/SOQ are indicative & payment shall bebased on actual/jointly certified measurements for the work done.

3.13 PAYMENT TERMS:

3.13.1 Contractor shall be paid against R.A. bills for the work done on thebasis of item rates as agreed in the contract after due certification byEngineer-in-charge.

3.13.2 Contractor's bill for executed works shall be accepted only whenjointly certified (contractor & EIL)signed measurements for the said works are

3.13.3 Final bill shall be submitted along with jointly certified & signedmeasurements within 2 months from the date of completion of total work.

3.13.4 10% of each R.A. bill will be withheld as retention money. In lieu ofretention money, contractor shall submit bank guarantee of 10% of contractvalue along with acknowledgement of purchase order valid for defects liabilityperiod of six months with claim period of three months extra.

3.14 DEFECT LIABILITY PERIOD:-

Defect liability period shall be six months from the date of completion of allthe jobs covered under this contract.

LD Clause - In case of delay, 0.5% / week of delay or part thereof up to amaximum 5% of the purchase order value shall be recovered.
